Welcome to Studio Madiba! These general terms and conditions apply to any offer we make and to any distance agreement concluded between you (the customer) and Studio Madiba.

By placing an order on our website, you agree to these terms of service. Please read them carefully before making a purchase.

Article 2 - The offer

  1. We take the utmost care in the descriptions, images, and specifications of our artworks, posters, and framed pieces to give you the best possible representation of the actual product.

  2. The colors of prints on your screen may differ slightly from the actual print due to screen settings and the texture of the paper used. This does not constitute grounds for compensation or rescission.

  3. Each offer contains sufficient information to clearly state the rights and obligations associated with the acceptance of the offer.

Article 3 - The agreement

  1. The agreement is concluded when you complete the entire ordering process and agree to the general terms and conditions, followed by a successful payment and receipt of our order confirmation by email.

  2. If you have concluded the agreement electronically, Studio Madiba will promptly confirm receipt of the acceptance of the agreement electronically.

Article 4 - Prices and payment

  1. All prices listed on the website include VAT and exclude any shipping costs (unless otherwise stated).

  2. Payment must be made immediately during the ordering process using the available payment methods (such as iDEAL, Bancontact, or credit card).

  3. Studio Madiba reserves the right to adjust product prices at any time, provided that the prices applicable at the time of your order form the basis.

Article 5 - Delivery and execution

  1. Studio Madiba takes the utmost care in receiving and fulfilling orders for artworks and framed pieces.

  2. The place of delivery is the address you, as a consumer, have provided to the company.

  3. We strive to ship orders as quickly as possible. In the event of a delay (for example due to high demand or custom work), you will be notified in a timely manner.

  4. The risk of damage and/or loss of products rests with Studio Madiba until delivery to you or a designated representative, unless expressly agreed otherwise.

Article 6 - Custom-made and personalized products

  1. If you choose a unique, custom-made, or personalized portrait (for example, a family composition specifically designed according to your wishes), the standard 14-day right of withdrawal does not apply once production has started.

  2. These custom-made items cannot be returned unless there is a clear manufacturing defect or damage upon delivery.

Article 7 - Retention of title

All delivered items remain the property of Studio Madiba until the full purchase price for the relevant items has been paid.

Article 8 - Intellectual property

  1. All designs, illustrations, texts, images, and logos published on the Studio Madiba website are the exclusive intellectual property of Studio Madiba or its licensors.

  2. It is not permitted to reproduce, copy, or commercially exploit material from this website without prior written permission.

Article 9 - Complaints procedure

  1. Do you have a complaint about a product (such as a damaged frame or printing error)? Please report this as soon as possible, but no later than 48 hours after discovery, via info@studiomadiba.nl.

  2. Please include a clear description and photos of the complaint/damage with your report.

  3. Submitted complaints will be answered within 5 business days from the date of receipt. If a complaint requires a foreseeably longer processing time, you will be informed within 5 days with an indication of when you can expect an answer.

Article 10 - Applicable law

All agreements, offers, and general terms and conditions are exclusively subject to Dutch law. Any disputes arising therefrom shall be submitted to the competent court in the Netherlands.
